This website and online store are operated by EFE CETIN LTD, trading as THE OPUS ART.
EFE CETIN LTD is a company registered in England and Wales under company number 17147031, with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.
Throughout these Terms, “THE OPUS ART”, “we”, “us”, and “our” refer to EFE CETIN LTD.
By accessing our website, purchasing a product, or otherwise using our services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). Please read them carefully before using the Services.
Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or limited.
1. Our Store
THE OPUS ART sells downloadable digital artwork, including digital wallpaper collections and related digital products.
Unless expressly stated otherwise, all products sold through our store are digital products only. No physical product will be shipped or delivered.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and Services.
2. Eligibility
By using our Services, you confirm that you have the legal capacity to enter into a contract with us or that you are using the Services with the permission of a parent or legal guardian where required by applicable law.
You must not use our Services for any unlawful or unauthorised purpose.
3. Products and Product Information
We aim to describe and display our digital products as accurately as reasonably possible.
Product pages may contain previews, mockups, cropped images, compressed images, or images displayed on devices for presentation purposes. These presentation images are intended to demonstrate the artwork and may not represent its exact appearance on every device or display.
The digital files, formats, quantities, and resolutions included with a purchase will be described on the relevant product page.
Colours and appearance may vary depending on your screen, display settings, device, and software.
4. Orders
When you place an order, you are offering to purchase the selected digital product subject to these Terms.
An order is accepted when we confirm the order and/or make the purchased digital content available to you.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- payment cannot be authorised;
- we reasonably suspect fraud or unauthorised activity;
- there is an obvious pricing or technical error;
- the product was listed incorrectly due to a genuine technical or administrative error; or
- we are legally required to do so.
If we cancel an order after payment has been taken and you have not otherwise received or retained the purchased digital content, we will provide an appropriate refund.
5. Prices and Payment
Prices are displayed in the currency shown at checkout.
Any applicable taxes, duties, or other charges will be displayed or handled as required by applicable law and the checkout process.
Payment must be successfully completed before access to paid digital content is provided unless expressly stated otherwise.
Payments may be processed by third-party payment providers. Your use of a payment method may also be subject to the terms and privacy policies of the relevant payment provider.
6. Digital Delivery
Purchased digital products are delivered electronically.
After successful payment, access may be provided through the order confirmation page, email, download link, customer account, or another electronic delivery method.
You are responsible for providing an accurate email address and ensuring that your device and software are capable of accessing the file formats clearly described on the relevant product page.

7. Right to Cancel and Immediate Digital Delivery
Where applicable consumer law provides a cancellation period for digital content, you may have a right to cancel before supply of the digital content begins.
Where you request immediate access to digital content during a statutory cancellation period, we may ask for your express consent to begin supplying the digital content immediately and your acknowledgement that you will lose the applicable right to cancel once supply begins.
Your statutory rights in relation to digital content that is faulty, not as described, or otherwise does not conform to applicable consumer law remain unaffected.

8. Licence to Use Purchased Artwork
Unless expressly stated otherwise on a product page, purchasing a digital product from THE OPUS ART grants you a limited, non-exclusive, non-transferable licence for personal use only.
You may:
- download and store the purchased files on your personal devices;
- use the artwork as a wallpaper or background on your personal devices; and
- make reasonable personal backup copies.
You may not, without our prior written permission:
- resell, redistribute, sublicense, share, gift, or otherwise transfer the digital files to another person;
- upload or distribute the original or substantially similar files on file-sharing websites, marketplaces, social media repositories, wallpaper platforms, or other distribution services;
- sell physical or digital products incorporating the artwork;
- use the artwork as part of merchandise, templates, stock assets, NFTs, commercial design products, or other products offered for sale;
- claim the artwork as your own work;
- remove copyright or ownership notices where present;
- provide the purchased files to others as part of a business, subscription, bundle, membership, or service; or
- use the artwork for commercial purposes unless we have expressly granted you a separate commercial licence in writing.
Purchasing a product gives you a licence to use the artwork as described above. It does not transfer ownership of intellectual property rights in the artwork to you.
9. Intellectual Property
The website, branding, product presentation, graphics, artwork, text, logos, designs, downloadable materials, and other content made available through THE OPUS ART are owned by or licensed to EFE CETIN LTD, except where otherwise stated.
They are protected by applicable intellectual property laws.
No rights are granted to you except those expressly provided under these Terms or required by applicable law.
THE OPUS ART and associated branding may not be used in a manner that falsely suggests endorsement, affiliation, or ownership.
10. Unauthorised Distribution
Unauthorised copying, resale, redistribution, publication, or commercial exploitation of purchased digital files may constitute a breach of these Terms and may infringe applicable intellectual property rights.
Where we reasonably identify unauthorised distribution, we may take proportionate steps to protect our rights, including requesting removal of infringing material or pursuing remedies available under applicable law.
11. Refunds and Problems With Digital Content
Refunds, cancellations, duplicate purchases, and problems with digital files are handled in accordance with our Refund & Cancellation Policy and applicable law.
Nothing in these Terms excludes or restricts any statutory rights or remedies you may have in relation to digital content that is faulty, not as described, or otherwise fails to meet legally required standards.
12. Acceptable Use
You must not:
- use our website or Services for unlawful or fraudulent purposes;
- attempt to gain unauthorised access to our website, systems, accounts, or infrastructure;
- introduce viruses, malware, malicious code, or other harmful material;
- interfere with the security or operation of the Services;
- scrape, harvest, or systematically extract content or data from our website where prohibited by law or without required permission;
- impersonate another person or provide deliberately false information in connection with a transaction; or
- use the Services in a manner that infringes the rights of another person.
13. Third-Party Services
Our Services may rely on or contain links to third-party services, including Shopify, payment providers, analytics providers, digital delivery providers, and other technology providers.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for third-party services to the extent that an issue is outside our reasonable control and responsibility. Nothing in this section excludes liability that cannot lawfully be excluded.
14. Service Availability
We aim to keep our website and digital delivery systems available and functioning properly, but temporary interruptions may occur due to maintenance, updates, technical problems, security incidents, or circumstances outside our reasonable control.
If a technical problem prevents you from accessing a digital product you have validly purchased, please contact us and we will take reasonable steps to restore or provide access.
15. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.
Subject to applicable law, we are not responsible for losses caused solely by circumstances outside our reasonable control or for losses that were not reasonably foreseeable when the contract was formed.
If you are purchasing as a consumer, nothing in these Terms removes or reduces the legal protections available to you under applicable consumer law.

Our collection and use of personal information are described in our Privacy Policy.
By using our Services, you acknowledge that personal information may be processed as described in that policy.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, business operations, technology, or legal requirements.
Changes will apply prospectively from the effective date of the updated Terms and will not remove rights already acquired under an existing purchase where doing so would be unlawful.
The latest version will be published on our website with an updated “Last updated” date.
18. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent permitted by law, and the remaining provisions will continue in effect.
19. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
20. Governing Law
These Terms and contracts between you and EFE CETIN LTD are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the country where you live.
Nothing in these Terms deprives a consumer of mandatory protections or rights to bring proceedings in a court that applicable law provides to them.
